Terms of service
Version: 24 October 2026 · In case of discrepancies, the German version prevails.
1. Provider, scope
- plinio® TL is provided by Bureau Wehrmann, owner Dennis Wehrmann, Bahnhofstraße 159, 86438 Kissing, Germany (“Provider”, “we”). Contact: hi@getplinio.com, +49 8233 7395511.
- These Terms apply to all contracts for the use of plinio TL via the website getplinio.com and the application at plinio.app (together the “Service”), including the free trial and the free Narrative Audit.
- The Service is offered exclusively to businesses within the meaning of section 14 of the German Civil Code (BGB), legal entities under public law and special funds under public law (“Customer”). Consumers may not use the Service. By registering, the Customer confirms that it acts in the course of its trade, business or profession.
- Deviating, conflicting or supplementary terms of the Customer do not become part of the contract, even if we do not expressly object to them.
- Individual agreements (in particular offers and contracts for Enterprise Premium, EU-only processing or an on-premise deployment) take precedence over these Terms.
2. Description of the Service
- plinio TL is web-based software for thought leadership marketing. The Service identifies topics based on public signals (“Discoveries”), produces strategy briefs and drafts using AI models, checks statements against sources, records predictions and measures the visibility of published content (SEO and GEO).
- The scope of the Service is determined by the booked plan (Starter, Growth, Enterprise Light, Enterprise Premium) and the description on getplinio.com/pricing valid at the time the contract is concluded. Quotas (markets, Discoveries, articles per month) apply per billing month; unused quotas expire at the end of the month and are not carried over.
- “Fair use” for Discoveries means use that corresponds to ordinary use by a team on the respective plan. In the case of use that significantly exceeds this, or automated use, we may ask the Customer to adjust its use or switch to a suitable plan.
- Predictions are not promises. Topic recommendations are based on probabilities. Figures on hit rates and head start (for example from the retrospective blind test on getplinio.com/proof) describe past results under test conditions. We do not owe any particular success, reach, ranking or the materialization of a topic.
- AI-generated content. Drafts are generated with AI models. Despite source checks, they may contain errors, inaccuracies or outdated information. The Service does not publish anything on its own; the Customer reviews and approves every piece before publication (“human-in-the-loop”).
- We continuously develop the Service and may change, replace or discontinue functions, provided the agreed core of the Service (in particular the quotas of the booked plan) is preserved and the change is reasonable for the Customer. We announce material restrictions in text form at least 30 days in advance; in that case the Customer may terminate with effect from the date the change takes effect.
3. Registration, conclusion of contract
- Use of the Service requires a customer account. Registration details must be complete and true; changes must be updated in the account without delay.
- The presentation of plans on the website is not a binding offer. By completing the order process (clicking the order button in checkout), the Customer submits a binding offer. The contract is concluded with our confirmation by email or when the plan is activated.
- Anyone registering on behalf of a company warrants that they are authorized to represent it.
4. Free trial
- New Customers can try plinio TL free of charge for five days. No payment details are required.
- Reduced quotas apply during the trial and are shown in the account.
- The trial ends automatically. A paid contract is only created if the Customer actively books a plan. After the trial, content created remains available in the account for 30 days and is then deleted unless a plan is booked.
- One trial is available per company.
5. Free Narrative Audit
- The Narrative Audit is a free, non-binding analysis based on the website, markets and competitors stated by the prospective customer.
- There is no entitlement to receive an audit. The audit does not create any obligation to conclude a contract.
- The audit is provided for information. We are liable for its completeness and for decisions based on it only in accordance with section 12.
6. Prices and payment
- The prices stated on getplinio.com/pricing at the time the contract is concluded apply. All prices are net prices plus statutory VAT. For Customers established in another EU member state with a valid VAT ID, the reverse-charge procedure applies.
- The Customer chooses between monthly and annual billing. With annual billing, we grant a discount of 20% compared with the monthly price. Fees are payable in advance for the entire billing period.
- Payment is made via the payment service provider Stripe by credit card or another payment method offered in checkout. Enterprise Customers may pay by invoice; invoices are due within 14 days without deduction.
- We issue invoices electronically. The Customer agrees to this.
- If the Customer is more than 14 days in default of payment, we may block access, after prior notice in text form, until the outstanding amount is paid. The obligation to pay remains unaffected.
- We announce price changes for existing contracts in text form at least 6 weeks before the end of the current billing period. They apply from the next billing period. The Customer may terminate until they take effect; we point this out in the announcement.
7. Term, termination, change of plan
- Contracts with monthly billing run for one month, contracts with annual billing for one year. They renew for the same period unless terminated.
- The Customer may terminate at any time with effect from the end of the current billing period, in the account or in text form (email to hi@getplinio.com). We may terminate with one month’s notice to the end of the billing period.
- The right to terminate for good cause remains unaffected. Good cause exists for us in particular if the Customer breaches section 9 despite a warning or is in default with more than two monthly fees.
- An upgrade to a higher plan is possible at any time and takes effect immediately; amounts already paid are credited pro rata. A downgrade takes effect at the end of the current billing period.
- Fees already paid are not refunded pro rata in the case of ordinary termination. If we terminate for reasons for which the Customer is not responsible, we refund prepaid amounts pro rata.
- After the contract ends, the Customer can export its content for 30 days. We then delete it unless a statutory retention obligation applies.
8. Customer obligations
- The Customer keeps its access credentials secret and informs us without delay if it suspects misuse. Accounts are personal; sharing accounts is not permitted. On plans with unlimited seats, the Customer creates a separate account for each person.
- The Customer is responsible for the content it brings into the Service (such as documents for the knowledge base, texts, competitors, instructions) and warrants that it is entitled to do so.
- The Customer reviews all output for accuracy, lawfulness and suitability before publication. It is solely responsible for published content, including towards third parties.
- If the Customer brings personal data of third parties into the Service, it is the controller for this data and concludes a data processing agreement with us (section 13).
9. Prohibited use
The Customer may not use the Service to
- create or distribute content that is unlawful, misleading, discriminatory or infringes the rights of third parties,
- present content as independent reporting or as a statement by another person who did not make it,
- query the Service automatically, via scripts or to an extent that endangers its stability,
- circumvent security mechanisms or analyse the Service in order to develop a competing product (reverse engineering, unless permitted by law),
- pass on access to third parties outside its organisation or offer the Service to third parties as its own service, unless expressly agreed (for example in the agency programme).
10. Rights to content
- All rights to the software, methods, models, databases, trademarks (in particular the registered word mark plinio®) and content of the Service remain with us or our licensors. For the term of the contract, the Customer receives a simple, non-transferable right to use the Service for its own business purposes.
- Content brought in by the Customer remains its property. It grants us the rights required to provide the Service (storing, processing, transmitting to the AI services used), limited to the term of the contract and the deletion periods.
- To the extent that rights exist in the output generated for the Customer (briefs, drafts, texts), the Provider grants the Customer transferable rights of use, unlimited in time and territory, for all types of use; these continue after the contract ends. We point out that purely AI-generated content is generally not protected by copyright under German law and that similar output may also be produced for other users.
- Writing patterns derived from the Customer’s edits (“memory bank”) are used only for the Customer and not for other customers. Customer content is not used to train general AI models, neither by us nor by the AI providers we use. Learning happens only within plinio TL: the Customer’s decisions on topics and its edits refine topic discovery and writing style exclusively for the Customer.
- We may use anonymised and aggregated usage data that does not allow conclusions about the Customer or individuals to improve the Service.
- We may use feedback and suggestions about the Service free of charge.
11. Availability, maintenance
- We strive for high availability but, outside a separately agreed service level agreement, do not owe any particular availability.
- We carry out planned maintenance outside usual business hours where possible and announce longer interruptions in advance.
- The Service uses third-party providers (hosting, AI models, data sources). Restrictions of these providers for which we are not responsible do not constitute a defect, provided we use reasonable alternatives.
12. Defects and liability
- The statutory provisions of the law of tenancy apply to defects, with the following proviso: strict liability for defects that already existed when the contract was concluded (section 536a (1) alt. 1 BGB) is excluded. The Customer reports defects without delay with a comprehensible description.
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent of any guarantee given.
- In the event of a slightly negligent breach of a material contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the Customer may regularly rely), our liability is limited to the typical, foreseeable damage, but no more than the fees paid by the Customer in the twelve months before the damaging event.
- Otherwise, liability for slight negligence is excluded.
- We are not liable for content the Customer publishes after its own review, nor for the materialization of predictions (section 2 (4)). For loss of data, we are liable only up to the effort that would have been required had the Customer backed up its data regularly; export functions are available at any time.
- The above limitations also apply to our legal representatives, employees and vicarious agents.
13. Data protection, data processing
- For personal data that we process as controller (such as account and billing data), our privacy policy at getplinio.com/privacy applies.
- Insofar as we process personal data on behalf of the Customer (for example in documents, texts or competitor analyses), the parties conclude a data processing agreement pursuant to Art. 28 GDPR. We provide our template on request or in the account; it contains the list of subprocessors.
- The Service is operated on servers in the EU and the USA. Customers from regulated industries can agree on processing exclusively within the EU or an on-premise deployment on request. With EU-only processing, a request that cannot be processed within the EU is not executed.
14. Confidentiality, references
- Both parties treat non-public information of the other party received under the contract as confidential and use it only to perform the contract. This obligation continues for two years after the contract ends.
- We name the Customer as a reference only with its prior consent.
15. Changes to these Terms
- We may amend these Terms with effect for the future if this is necessary due to changes in the law, case law, market conditions or further development of the Service and does not unreasonably disadvantage the Customer.
- We notify changes in text form at least 6 weeks before they take effect. If the Customer does not object before they take effect, the changes are deemed accepted; we point this out specifically in the notification. If the Customer objects, either party may terminate with effect from the date the changes take effect.
- Changes to the main obligations or to prices are not made under this clause but under section 2 (6) and section 6 (6).
16. Final provisions
- The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- The exclusive place of jurisdiction for all disputes arising from this contract is Augsburg, Germany, if the Customer is a merchant, a legal entity under public law or a special fund under public law.
- Declarations under this contract may be made in text form (for example by email) unless otherwise stated.
- Should any provision be invalid, the remainder of the contract remains valid. The statutory provision replaces the invalid provision.
- These Terms are available in German and English. In case of discrepancies, the German version prevails.
